1. Acceptance of these terms
These Terms of Service ("Terms") form a binding agreement between you ("you", "user", "customer") and the operator of WhatsApp Gateway ("we", "us", "our"), regarding your use of the website at wapi.aramin.co, the dashboard, the REST API, the AI features and any related services (collectively, the "Service"). By creating an account, signing in, or sending any request to the API, you confirm that you have read, understood and agreed to these Terms.
If you do not agree, you must stop using the Service immediately. We may update these Terms from time to time; material changes will be communicated by email or in-app notice at least 7 days before they take effect.
2. What the Service does
WhatsApp Gateway is a multi-tenant software-as-a-service platform that lets each customer:
- Link one or more personal WhatsApp numbers via QR code (using the WhatsApp Web protocol).
- Send and receive messages through a REST API and webhook events.
- Optionally enable an AI-powered auto-reply assistant, billed per token from a top-up wallet.
- Manage subscriptions per linked phone number.
We are not affiliated with, endorsed by, or sponsored by WhatsApp LLC or Meta Platforms, Inc. The Service is intended for personal automation and small-team productivity; it is not a substitute for the WhatsApp Business API and must not be used in any way that breaches the WhatsApp Terms of Service.
3. Eligibility & account
- You must be at least 18 years old to create an account.
- You must provide accurate registration details and keep them up to date.
- You are responsible for safeguarding your password, API tokens and any session devices linked to your account.
- You must not share your account with anyone outside the team it was created for.
4. Acceptable use
You agree not to use the Service to:
- Send unsolicited bulk messages, spam, scams, phishing, or fraud of any kind.
- Distribute malware, illegal content, hate speech, harassment, or sexually explicit material.
- Violate any applicable law, including export controls, sanctions, data-protection or telemarketing laws.
- Circumvent the platform's anti-spam controls, including by creating multiple accounts.
- Reverse-engineer, scrape or attempt to exploit non-public parts of the Service.
We may suspend or terminate your account immediately and without refund if we reasonably believe you have breached this section, or if WhatsApp / our upstream providers require us to do so.
5. WhatsApp account & sessions
You retain all rights to your WhatsApp account. By linking a number to the Service you explicitly authorise us to operate that session on your behalf, including reading and sending messages, until you remove the number or log out from the WhatsApp app. We do not store your WhatsApp password — we use the WhatsApp Web QR pairing flow.
6. AI features
When AI auto-reply is enabled, your messages, the relevant chat history and your system prompt are forwarded to the AI provider configured by the platform operator (for example OpenAI, OpenRouter, or a custom OpenAI-compatible endpoint) to generate a response. The provider's own terms and privacy policy apply to that data.
AI-generated replies may be inaccurate, offensive, or out-of-context. You are responsible for any message sent from your number, including those generated by the AI assistant.
7. Billing & wallet
- Per-number subscription — a recurring fee charged for each linked WhatsApp number, billed in advance via Lemon Squeezy or Paddle.
- Wallet (AI usage) — a prepaid balance, topped up via Lemon Squeezy or Paddle. Each successful AI reply deducts cents based on the real prompt and completion tokens used multiplied by the operator-set price.
- All prices are displayed in the dashboard before purchase and include applicable VAT/GST where required.
- Wallet balances are non-transferable, do not earn interest and are not redeemable for cash except as required by the Refund Policy.
- If the wallet balance reaches zero, AI replies are paused; sending and receiving messages still works normally.
Subscriptions auto-renew until cancelled. You may cancel any time from the Billing page; cancellation takes effect at the end of the current billing period.
8. Refunds
Refunds are governed by our separate Refund Policy.
9. Intellectual property
We own the Service, including all software, designs, trademarks and documentation. You receive a limited, revocable, non-exclusive, non-transferable licence to use the Service for the duration of your subscription. You retain all rights to the messages, prompts and data you submit.
10. Service availability
We make commercially reasonable efforts to keep the Service available, but it is provided on an "as is" and "as available" basis. We do not warrant uninterrupted operation, error-free behaviour or that the Service will meet a specific business need. WhatsApp may change its protocol at any time; such changes may temporarily impact the Service.
11. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages (including lost profits, lost data or business interruption), even if we have been advised of the possibility of such damages.
Our aggregate liability for any claim arising out of or relating to the Service is capped at the greater of (a) the fees you paid us in the 3 months preceding the claim, or (b) USD 50.
12. Indemnification
You agree to indemnify and hold us harmless against any third-party claim arising out of your use of the Service, your messages, your AI prompts or your breach of these Terms.
13. Termination
You may close your account any time. We may suspend or terminate your account for breach of these Terms, non-payment, or as required by law or our upstream providers. On termination all WhatsApp sessions are revoked and your data is deleted within 30 days (subject to legal retention requirements).
14. Governing law
These Terms are governed by the laws of the jurisdiction of the operator's registered business address. Disputes that cannot be resolved amicably will be brought before the competent courts of that jurisdiction. Nothing in these Terms removes any non-waivable consumer-protection rights you have in your own country.
